Introduction
These Terms & Conditions (“Terms”) govern your use of the Site, any purchases you make, your participation in our programmes, and any other interactions you have with ZanaAfrica. By accessing or using the Site or Services, you acknowledge that you have read, understood, and agree to be bound by these Terms. If you do not agree, you must not use the Site or Services. These Terms constitute a legally binding contract between you and ZanaAfrica.
Definitions
- “You” or “User” refers to any person who accesses or uses the Site or Services, including donors, programme participants, shoppers and visitors.
- “Products” refers to the physical goods sold through the Site, including Nia disposable pads, reusable pads, menstrual cups, baby diapers, dignity kits and related merchandise.
- “Programmes” refers to our rights-based reproductive health education, life-skills curriculum (Nia Yetu), health-link hotline, digital training and other educational services.
Using the Site and Services
- Eligibility: You must be at least 18 years old and legally capable of entering into binding contracts to create an account or purchase products. Minors may use the Site under the supervision of a parent or guardian.
- Accounts: To access certain features (such as placing orders, enrolling in programmes or receiving updates), you may need to create an account. You agree to provide accurate, current and complete information and to update it as necessary. You are responsible for maintaining the confidentiality of your password and for all activities that occur under your account. Notify us immediately if you suspect unauthorised use of your account. We reserve the right to refuse registration, suspend or terminate accounts and to refuse orders at our sole discretion.
- Permitted use: You agree to use the Site only for lawful purposes and not to:
- Violate any applicable law or regulation;
- Infringe the rights of others, including privacy, intellectual property and contractual rights;
- Post or transmit any content that is false, defamatory, offensive, obscene, threatening, discriminatory or otherwise objectionable;
- Transmit any viruses, malware or other harmful code;
- Harvest or collect information about other users without their consent;
- Use automated scripts to collect information from or interact with the Site.
- Educational content: Materials provided through our programmes, magazines, hotline, chatbot or blog are for informational and educational purposes only. They do not constitute medical advice. Always consult a qualified health professional regarding medical questions.
Orders, payments and donations
- Product information: We strive to ensure that product descriptions and prices are accurate and current. However, typographical errors, omissions or inaccuracies may occur. We reserve the right to correct errors and to change or update information at any time without prior notice. All prices include applicable taxes.
- Orders: When you place an order, you will receive an order confirmation. Acceptance of your order occurs only when we dispatch the product or otherwise communicate acceptance. We reserve the right to limit or refuse any order, including for suspected fraud or misuse. Orders are subject to product availability; if an item is unavailable, we will notify you and may offer a substitute or refund.
- Payments: You agree to pay all fees and charges incurred in connection with your order, including shipping fees (if applicable). We accept mobile money, credit/debit cards and other payment methods indicated on the Site. Payments are processed by trusted third-party payment processors; your financial information is processed securely and used only to complete the transaction.
- Donations: Donations made through the Site are voluntary and non-refundable unless otherwise required by law. We will provide receipts for charitable contributions upon request.
- Shipping and delivery: We ship products within Kenya and to other jurisdictions as specified on the Site. Estimated delivery times are provided at checkout; actual delivery times may vary. Title and risk of loss for products pass to you upon our delivery to the carrier. You must provide accurate delivery information; we are not responsible for failed deliveries resulting from incorrect information.
- Returns and exchanges: For hygiene reasons, we cannot accept returns of opened sanitary products. If you receive defective or incorrect items, please contact us within 7 days of delivery so we can arrange an exchange or refund. Programmes and digital products are non-returnable once delivered.
Programme participation
- Registration: Some programmes require registration or parental/guardian consent. You agree to provide truthful information and to comply with programme guidelines.
- Conduct: We expect participants to respect facilitators and peers and to comply with our child-safeguarding and anti-harassment policies. We may remove individuals who violate programme rules.
- Health information: Our programmes and hotline may discuss sensitive topics, including reproductive health, mental health and gender-based violence. All participants’ information is handled confidentially and used only to provide support and referrals.
Intellectual property
All content on the Site (including text, graphics, logos, images, videos, software, and programme materials) is owned by or licensed to ZanaAfrica and is protected by copyright and other intellectual property laws. You may view, download for caching purposes, and print pages for your personal, non-commercial use only. You must not reproduce, redistribute, sell, rent, adapt, transmit, display, perform, or create derivative works from any content without our prior written consent. Third-party links The Site may include links to third-party websites, social media platforms, or resources. These links are provided for convenience and do not imply endorsement by ZanaAfrica. We are not responsible for the content or privacy practices of any third-party sites. Accessing and using third-party websites is at your own risk.
Disclaimer of warranties
Our Services are provided on an “as is” and “as available” basis. While we aim to keep information accurate and current, we make no warranties, express or implied, regarding the availability, reliability, or accuracy of the Site, programmes, or products. We do not guarantee that the Site will be uninterrupted, secure, or free of errors, that defects will be corrected, or that the Site or the server hosting it are free of viruses or other harmful components.
Limitation of liability
To the fullest extent permitted by law, ZanaAfrica and its affiliates, directors, employees, agents and partners shall not be liable for any indirect, incidental, special, consequential or punitive damages, including lost profits, revenue, data or goodwill, arising out of or in connection with the Site or Services, even if informed of the possibility of such damages. In no circumstances shall our total liability exceed the amount you have paid us for products or services in the past three months (or KSh 1,000, whichever is greater).
Indemnification
You agree to indemnify and hold harmless ZanaAfrica and our affiliates, directors, officers, employees, and agents from and against all losses, liabilities, claims, damages, costs, and expenses (including reasonable legal fees) arising from or relating to (i) your use of the Site or Services; (ii) any breach of these Terms; (iii) any content you submit; or (iv) your violation of any law or third-party right.
Changes to the Terms
We may change these Terms at any time. When we do, we will update the “last updated” date and post the revised Terms on the Site. Your continued use of the Site after such changes indicates your acceptance of the updated Terms. If you do not agree to the revised Terms, you must stop using the Site.
Governing law and dispute resolution
These Terms are governed by Kenyan law. Any dispute related to these Terms, the Site, or Services shall fall under the exclusive jurisdiction of Kenyan courts. We encourage you to contact us first to try resolving the dispute informally before starting formal proceedings.
